Reservations ...

To those who have been following the OBC reservation debate post the Supreme Court (SC) judgement, yours truly has the following questions.
1) Are reservations applicable to post grad institutions?
2) How has the SC defined creamy layer?
3) What is the SC's stand regarding reservations in private and minority educational institutions?
I have been surfing around for answers to the above questions and getting contradictory answers. Request someone to throw some gyan. When I say gyan, I am not referring to the grand fartings of Arjun Singh and his ilk who would gladly push for reservations in creches, movie multiplexes and old age homes if it got them a few extra votes and some undeserved footage. I want to know what the SC actually said...
p.s. - Read in the Hindu that Mayawati while welcoming the SC judgement asked for reservations to be extended to the poor among the "forward" castes. This is why I simply love democracy :)
p.p.s. - I am neither for nor against reservations. In fact, I have no opinion. The truth is I am damn confused about it all.

I sympathise with you as me too not clear on the need for Reservation.

1.Recent SC decision for 27% reservation to OBC is for Central education & Professional institutions. So it includes all Post Graduate institutions funded by Central Government.

2. Creamy layer used by Supreme Court in Mandal Comission recommendation for OBC quota in Central Govt jobs. Below it is reproduced Verbatim –

"These include chidren of constitutional functionaries including the President, Vice-President and Judges of the Supreme Court and High Courts. Children of the members of the Union Public Service Commission (UPSC) are also excluded as are Group A and B or Class I and II officers of all-India and state services. Children of certain public sector employees are also excluded. Certain property-related ceilings, on irrigated and unirrigated land holders, and plantation owners have also been imposed, and in certain cases children whose parents have an annual income of over Rs 2.5 lakh are also excluded. Children of doctors, dentists, engineers, chartered accountants, IT consultants, media professionals, authors, and sports professionals are also included in the creamy layer".

3. Implementation of OBC quota for minority institutions was stressed by the Supreme Court last year during the hearing for OBC quota in Educational institution. But no clear directive issued for its implementation.

Even though it is not clear who the actual beneficiaries are but we can expect that the Govt will be very keen to rollout the reservation immediately.

That's just the tip of the iceberg. As far as I know, there is a three page document about who is eligible and who is not - examples being if dad is class I officer, mom is class II officer then not eligible etc etc. Clarity are not there even for the IIMs, so hardly expect individuals to have clarity right now. Insider info are :)
